Understanding Mediation

Mediation is a process of facilitated negotiation where parties involved in a conflict come together to discuss their issues, explore solutions, and reach agreements with the help of a neutral third party, known as a mediator. This approach to conflict resolution empowers individuals to actively participate in finding mutually agreeable solutions in a supportive and structured setting.

Why should I choose mediation over other conflict resolution methods?

Mediation at Nielsen Nurture offers a collaborative, empowering and confidential approach to resolving conflicts.  Our process encourages open communication, fosters understanding and focuses on sustainable solutions that prioritise the needs and interests of all parties involved.

How long does the mediation process take?

The duration of the mediation process varies depending on the complexity of the issues, the willingness of the parties to engage in discussions, and the pace at which agreements are reached.  On average, mediation at Nielsen Nurture can span from a few sessions to several meetings, with the goal of achieving meaningful resolutions efficiently.

Is the mediation suitable for all types of conflicts

Mediation is a versatile and effective method for resolving a wide range of conflicts including family disputes, workplace disagreements, neighborhood issues and more.  At Nielsen Nurture, our experienced mediators can adapt the process to suit the unique concerns and circumstances presented in each case.

Is mediation legally binding?

All spoken and written communication in mediation is legally privileged and without prejudice; what is said cannot be used outside of mediation, even in a court or at a tribunal.  Mediators in Scotland are protected under the Civil Evidence (Family Mediation) (Scotland) Act 1995.

With agreement from all parties, decisions reached in mediation can be formalised into legally binding documents which provide clarity and enforceability saving on time, misinterpretation, expense and stress.

Should this be the chosen route, we will refer you to one of our trusted legal specialists who will guide you through the process.

What role does the mediator play in the mediation process?

The mediator at Nielsen Nurture serves as a neutral third party who facilitates communication, guides discussions, and assists parties in exploring options for resolution. They do not impose decisions but help parties reach their own agreements through active listening, problem-solving techniques, and creating a supportive environment for constructive dialogue.
